This Terms of Use Agreement (hereinafter referred to as the "Agreement") governs the relationship between the sole proprietor ALEKSEI ZAIAKIN PR BEOGRAD (hereinafter referred to as the "Site Owner") and an individual (hereinafter referred to as the "User") using the website netadver.rs (hereinafter referred to as the "Website").

By accepting this Agreement, the User also confirms their consent to the aforementioned documents.

2.1. The Website provides Users with information about goods (Serbian wines) and services, and also offers the following interactive functions:

• Booking tables at the Site Owner's establishment.
• Creating a personal account.
• Subscribing to informational and marketing newsletters.

2.2. The procedure for making purchases, including payment, delivery, and return of goods, is governed by the Terms of Purchase.
2.3. The collection, storage, and use of the User's personal data when using any of the Website's functions are governed by the Privacy Policy.

3. Rights and Obligations of the Parties

3.1. The User undertakes:

• To provide accurate information during registration and use of the Website's functions.
• Not to use the Website for any unlawful activities.
• To be fully responsible for maintaining the confidentiality of their account credentials (login and password).
• To read this Agreement and other legal documents of the Website before using it.

3.2. The Site Owner has the right:

• To change and update the content and functionality of the Website at their discretion.
• To temporarily or permanently suspend the Website's operation for maintenance.

5. Limitation of Liability

5.1. The Site Owner makes every effort to ensure the uninterrupted operation of the Website but does not guarantee the absence of technical errors or failures. The Website is provided on an "as is" basis.
5.2. The Site Owner is not liable for any direct or indirect damages incurred by the User as a result of using or being unable to use the Website, or as a result of unauthorized third-party access to the User's account.

6. Dispute Resolution

6.1. All disputes and disagreements that may arise between the Site Owner and the User shall be resolved through negotiations.
6.2. If an agreement cannot be reached through negotiations, disputes shall be resolved in the competent court of Belgrade in accordance with the current legislation of the Republic of Serbia.

7. Final Provisions

7.1. This Agreement comes into effect upon its publication on the Website and is valid indefinitely.
7.2. The Site Owner reserves the right to amend the Agreement without special notification to the User. The new version of the Agreement comes into effect upon its publication on this page. The User undertakes to monitor for changes independently.

These Terms of Purchase (hereinafter referred to as the "Terms") define the procedure for ordering, payment, delivery, and return of goods purchased through the website netadver.rs (hereinafter referred to as the "Website"). These Terms constitute a public offer and an integral part of the sale and purchase agreement concluded between the sole proprietor ALEKSEI ZAIAKIN PR BEOGRAD (hereinafter referred to as the "Seller") and an individual (hereinafter referred to as the "Buyer").

1. General Provisions

1.1. Age Restriction: The sale of alcoholic beverages is carried out exclusively to persons who have reached the age of 21. By placing an order, the Buyer confirms that they are 21 years of age or older. The Seller reserves the right to request a document verifying the Buyer's age at the time of order handover. 1.2. Definitions: * Seller: ALEKSEI ZAIAKIN PR BEOGRAD, MB: 67289773, PIB: 114053903. * Buyer: Any individual who meets the age requirements and has placed an order on the Website.

2. Order Process and Confirmation

2.1. The Buyer creates an order by selecting goods on the Website and filling in the required information in the shopping cart. 2.2. The minimum order value for delivery is 5,000 RSD. No minimum order value is set for self-pickup orders. 2.3. If an ordered item is out of stock, the Seller will contact the Buyer by phone to agree on changes to the order. 2.4. Order Confirmation: An order is considered accepted, and the sale and purchase agreement is considered concluded only after the Seller makes a phone call to the Buyer at the number provided in the order to finalize all details.

3. Prices and Payment Methods

3.1. All prices on the Website are listed in Serbian Dinars (RSD) and include Value Added Tax (VAT). 3.2. Available payment methods: * Cash on delivery. * By bank card on delivery (Visa, Mastercard, DinaCard). * Bank Transfer: An invoice for payment is sent to the Buyer after the order is confirmed and must be paid within 2 (two) business days. If payment is not made within this period, the order will be cancelled.

4. Delivery

4.1. Delivery Zone: Delivery is carried out within the zone indicated on the map available on the Website. For addresses outside this zone, the Seller may, on a case-by-case basis, offer delivery, self-pickup, or cancel the order. 4.2. Delivery Cost: * The standard delivery cost (for the next day) is 500 RSD. * For orders of 10,000 RSD or more, next-day delivery is free of charge. * Same-day delivery (if available) is 1,000 RSD. 4.3. Delivery Time: The Seller agrees on a convenient delivery time with the Buyer by phone. 4.4. Failed Delivery Attempt: If the Buyer is not present at the address, the Seller will contact them and offer self-pickup or a second delivery attempt (at a cost of 500 RSD). If the delivery fails twice, the order is cancelled.

5. Self-Pickup

5.1. The Buyer can select the self-pickup option when placing an order. 5.2. The order can be picked up at the Seller's bar address. The address and opening hours are specified during the checkout process. 5.3. The Seller notifies the Buyer by phone when the order is ready for pickup. 5.4. The order is held for 2 (two) business days. This period can be extended by mutual agreement.

6. Right of Withdrawal and Complaint Procedure

All procedures described in this section are carried out in accordance with the Consumer Protection Act of the Republic of Serbia (Serbian: Zakon o zaštiti potrošača, Službeni glasnik RS, no. 88/2021).
6.1. Right of Withdrawal (Return of Goods of Proper Quality)

• The Buyer has the right to withdraw from a distance contract within 14 days from the moment of receiving the goods, without providing a reason.
• To exercise this right, the Buyer must send a written notice to the Seller. It is recommended to use the "Withdrawal Form" available for download on the Website and send it to the email: netadver.rs@gmail.com.
• The Buyer is obliged to return the goods no later than 14 days from sending the withdrawal notice. The goods must be unused (bottles unopened), in their original packaging, and in a saleable condition.
• The Buyer shall deliver the returned goods to the Seller's bar at their own expense.
• The Seller will refund the amount paid for the goods to the Buyer within 14 days of receiving the returned goods.

6.2. Complaint Procedure (for Non-Conforming Goods)

• Grounds for Complaint: The Buyer may file a complaint if the delivered goods are damaged, do not match the order, or have a hidden quality defect (e.g., "cork taint").
• Deadlines: Complaints regarding obvious defects (damage, wrong item) must be made at the time of order acceptance. Complaints regarding hidden defects must be made within a reasonable period after discovery.
• Filing Procedure: A complaint must be submitted in writing to the email: netadver.rs@gmail.com or in person at the Seller's bar with proof of purchase. The person responsible for handling complaints is the director, Aleksei Zaiakin.
• Review: The Seller is obliged to keep a record of received complaints and to respond to the Buyer's complaint in writing (via email) within 8 days of its receipt.
• Resolution: If the complaint is justified, the Seller undertakes to replace the item with a conforming one or to provide a refund. For the assessment of hidden defects, the Buyer must provide the nearly full bottle of the defective wine.

7. Out-of-Court Dispute Resolution

In accordance with the law, the Seller informs the Buyer of the possibility of out-of-court settlement of consumer disputes. The Seller is willing to participate in this procedure. The competent body for out-of-court dispute resolution is an entity from the list maintained by the Ministry of Trade, Tourism, and Telecommunications of the Republic of Serbia.

8. Final Provisions

8.1. For all matters not regulated by these Terms, the provisions of the applicable legislation of the Republic of Serbia shall apply. 8.2. In the event of a dispute, the Parties will make every effort to resolve it through negotiations. If an agreement cannot be reached, the dispute shall be resolved in the competent court in Belgrade.
